Terms & Conditions

These terms govern all bookings made through Morocco Tours & Activities. They are established in compliance with Loi n° 11.16 regulating the profession of travel agent in Morocco.

1. Parties to the Contract

These terms constitute a binding service contract between:

  • The Travel Agent: Morocco Tours & Activities, a licensed travel agency (agence de voyages agréée) under Moroccan Loi n° 11.16, Licence n° [LICENCE-PLACEHOLDER], registered in Marrakech, Morocco.
  • The Client: any individual or group that books a service through our website, by phone, or by email.

By completing a booking you confirm that you have read, understood, and accepted these terms in full.

2. Services Covered

These terms apply to all services sold by Morocco Tours & Activities, including:

  • Day trips and excursions
  • Multi-day tours and packages
  • Private tours and transfers
  • Entry tickets to monuments and attractions
  • Any combination of the above

Each booking is described in detail on the relevant experience page, including duration, itinerary, inclusions, exclusions, and departure point.

3. Pricing & Payment

All prices are displayed per person unless otherwise stated. Prices are in the currency shown at the time of booking (EUR by default; MAD prices may also be displayed).

We operate on a Reserve now, pay later model. Full payment is collected at the time of the experience unless a specific advance payment is indicated.

Prices include VAT where applicable. Any additional taxes or fees specific to a site or activity are indicated in the booking details.

4. Cancellation & Refunds

Our full cancellation policy is described on the Cancellation Policy page. The key points are:

  • Free cancellation up to 24 hours before the experience start time.
  • Cancellations made less than 24 hours in advance are non-refundable.
  • No-shows are charged in full.

These conditions comply with Loi n° 11.16, Art. 18, which requires cancellation terms to be communicated to the client before contract conclusion.

5. Agent's Liability (Art. 20, Loi 11.16)

Morocco Tours & Activities is liable for the proper execution of all obligations arising from the booking contract, whether these services are performed by us directly or by sub-contractors (transport providers, accommodation, local partners).

Our liability does not apply in cases where non-performance is due to:

  • The client's own actions or failure to comply with instructions;
  • Unforeseeable or unavoidable actions of a third party unrelated to the services;
  • Force majeure (see Section 6).

We hold a mandatory civil liability insurance policy as required by Art. 5 of Loi 11.16.

6. Force Majeure

Neither party shall be held liable for failure to perform obligations caused by events beyond their reasonable control, including but not limited to: natural disasters, extreme weather, civil unrest, acts of government, epidemic or pandemic declarations, or transportation strikes.

In such cases, we will offer a full refund or a credit note, at the client's choice.

7. Licensed Guides Only (Art. 21, Loi 11.16)

All tours involving guide services use only government-accredited tour guides (guides de tourisme agréés) as required by Moroccan law. We do not engage unlicensed individuals to accompany our clients.

8. Client's Responsibilities & Border Requirements (Art. 19, Loi 11.16)

The client is solely responsible for ensuring they hold all documents required for travel, including:

  • A valid passport (minimum 6 months validity beyond the travel date);
  • Any visas required for entry into Morocco;
  • Any relevant travel insurance.

Morocco Tours & Activities is not liable for any consequences arising from the client's failure to hold the required travel documents.

9. Complaints & Disputes

Any complaint must be submitted in writing to contact@moroccotoursandactivities.com within 30 days of the experience date. We will acknowledge your complaint within 5 business days and aim to resolve it within 15 business days.

10. Governing Law

These terms are governed exclusively by Moroccan law, in particular Loi n° 11.16 relating to the regulation of the travel agent profession, and its implementing decree n° 2.21.80. Any disputes shall be submitted to the competent courts of Marrakech, Morocco.
